The decision by the National League for Democracy (NLD) not to stand in this year’s elections in Burma is not unexpected.

Ever since the ruling military junta passed the constitution two years ago, the party led by Aung San Suu Kyi has been trapped between a rock and a hard place. The new election laws passed just a few weeks ago appear to have been the final straw.

Britain is backing moves to refer Burma's military leaders to the international criminal court for investigation into war crimes and crimes against humanity. The move is part of a heightened campaign to force the junta to embrace genuine democratic reforms, diplomatic and government sources told the Guardian today.

In a tough démarche that will increase pressure on the isolated regime ahead of planned elections this autumn, Britain's ambassador to the UN said the UK supported a recommendation by the UN special rapporteur on human rights in Burma that The Hague-based international court opens a war crimes investigation.

A senior UN official has called for Burma's military rulers to be investigated over allegations of crimes against humanity and war crimes perpetrated against Burmese civilians, in a move that will sharply increase pressure on the isolated regime ahead of controversial national elections due later this year.
In a draft report to the UN Human Rights Council in Geneva, Tomás Ojea Quintana, special rapporteur on human rights in Burma, described "a pattern of gross and systematic violation of human rights" <snip>
"There is an indication that those human rights violations are the result of a state policy that involves authorities in the executive, military and judiciary at all levels," he said.

Burma law formally bars Aung San Suu Kyi from election

Burma has issued a law which will bar pro-democracy leader Aung San Suu Kyi from taking part in planned elections and could force her party to expel her.
The new law prohibits anyone with a criminal conviction from belonging to a political party.
Ms Suu Kyi has been detained on various charges for most of the past 20 years, after winning the last polls in 1990.
She was already excluded from political office by a constitutional bar on people with foreign spouses.

The first details of Burma's newly enacted election laws have been published in state-controlled media.
Burma's military government announced on Monday that the long awaited laws had been passed - a crucial step.
No date for the poll has been set, but the ruling generals have promised that it will be sometime this year.

The Burmese opposition leader Aung San Suu Kyi failed in her latest bid to end more than a decade of house arrest today after the country's highest court threw out an appeal against her sentence.
The supreme court's decision was widely expected but her lawyer said he would launch a final special appeal to the supreme court after establishing the reasons why the latest attempt had been rejected. "The court order did not mention any reasons," he said.
The British ambassador Andrew Heyn attended the court session along with diplomats from Australia, France and the US.
"Although the decision comes as no surprise, it is deeply disappointing," he said.

Burma's ruling junta has released the deputy leader of the country's pro-democracy party from nearly seven years in detention, but offered no indication that he or still-detained party leader Aung San Suu Kyi would be allowed to take part in this year's elections.
The release yesterday of 82-year-old Tin Oo, who helped found the National League for Democracy with Aung San Suu Kyi, comes shortly before a UN envoy visits Burma to evaluate the regime's progress on human rights.

Burma's opposition leader, Aung San Suu Kyi, may soon be released so she can play a role in next year's election, a senior Burmese diplomat has said.
"There is a plan to release her soon ... so she can organise her party," Min Lwin, a director-general in the foreign ministry, to ld the Associated Press. He gave no details and it was unclear whether Aung San Suu Kyi would be allowed to campaign or stand for election.
Despite the conciliatory remarks, the country's constitution includes provisions that bar her from holding office and ensure the primacy of the government in the military.
The Nobel peace prize winner has spent 14 of the last 20 years under house arrest.

Aung San Suu Kyi has been found guilty in her trial for “violating the conditions of her house arrest”. She has been sentenced to another 18 months of house arrest, keeping her locked away until after Burma’s next general election. She has already spent 13 of the past 20 years in detention, but is one of more than 2,100 political prisoners currently locked away in Burma.

Please send an appeal letter to the Burmese authorities calling for the release of Aung San Suu Kyi – and demand human rights for Burma.

She is a campaign officer in the London-based Burma Campaign UK. Her father was arrested again along with Min Ko Naing and Ko Ko Gyi because of his involvement in the demonstrations in August 2007.
